Does Claude train on your code and prompts? No. Do they own your outputs? No, you do. Both die on contact with the actual Anthropic terms of service. But do they read your usage in aggregate, and does that steer what they build next? Absolutely. Your traces get tumbled with everyone else's, anonymized, and what comes out is not your data anymore. It is a market map. 🔥 THE PATTERN NOBODY SAYS OUT LOUD: Cursor gets huge, then Claude Code. Figma MCP usage explodes, then Claude Design. Security tooling takes off, then Claude Security. Then Claude Life Science. One is a coincidence. Four is a confirmation. This is not evil, this is what a platform IS. OpenAI and Google run the same play. ⚖️ Not all customers are equal. Free plan means you are the product. Pro and Max sit under consumer terms. Teams, enterprise, and the commercial API get materially stronger anthropic data privacy protections, and Claude Code terms inherit whatever tier you are logged into. Only INCENTIVES protect you, never goodwill: one terms of service violation triggers an enterprise exodus that kills the company. That is the real firewall. 🛠️ COMMODITY AGENTS vs IP AGENTS. Most agentic coding is commodity: CRUD, boilerplate, glue. Ship it, do not lose sleep. IP agents are different: your domain logic, your hand farmed evals, your traces, your workflows. Scarce, asymmetric, compounding. The whole test is one sentence, and if you remember nothing else remember this: if a competitor could read my full agent trace, would it matter? 🪜 THE AI SOVEREIGNTY LADDER, the actual solution: • Tier 0: Consumer subscription. Lowest protection. • Tier 1: Commercial API. Better terms, ZDR options. • Tier 2: Own the control plane. Your gateway, your router, your traces. • Tier 3: Model cloud (AWS, GCP Vertex, Azure Foundry). No lab sampling at all. • Tier 4: Hybrid private ai. Rent the GPUs, OWN the open weight model. • Tier 5: On prem metal. Optimal, and financial suicide for almost everyone. 🧠 Open weight models are the escape hatch. Kimi K3, GLM 5.2, Minimax, Qwen. The Chinese labs are commoditizing the closed US labs and that is GOOD for us. But open weights does not mean overseas discount APIs whose terms cannot be enforced. Private ai and private llms mean you hold the weights, the traces, the evals, and the routing. 🌟 I am a genuine fan of Claude and of OpenAI. But they have grown to a size where their incentives changed, and what is best for them is not automatically what is best for you. Never in history has a technology asked you to pay in cash AND in know how. Defend accordingly. Stay focused and keep building.
